A Canadian Labour Market Impact Assessment (or LMIA) is required if a Canadian employer seeks to hire a temporary foreign worker to fill a position in Canada. In order to protect jobs for Canadian permanent residents and citizens, the Canadian labour force, an assessment must be conducted to determine if the position can be filled by a Canadian citizen or permanent resident. If the report indicates that the labour market can accommodate the foreign worker and that there is a void to be filled, then a positive report is issued to the employer. The applicant must include the Labour Market Impact Assessment with their application to Employment and Social Development Canada Service Canada. The employer must be qualified to participate in any Canadian immigration programs and must obtain and submit the report themselves. Once the employer seeking to hire a temporary foreign worker receives the positive LMIA, the foreign worker can proceed with the work permit application process. The LMIA can also apply to permanent resident programs as well.
